These Terms of Service ("Terms") govern your access to and use of the Player Benchmark website and services at playerbenchmark.com ("Platform"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 16 years of age (or 13 in jurisdictions where that is the applicable minimum) to create an account and use the Platform. By registering, you represent that you meet the applicable age requirement. If you are under 18, you represent that you have parental or guardian consent to use the Platform.

2. Account Registration & Security

To access competitive features, you must create an account. You agree to:

  • Provide accurate and truthful information during registration.
  • Keep your login credentials secure and confidential.
  • Accept full responsibility for all activity that occurs under your account.
  • Notify us immediately at [email protected] if you suspect unauthorized access to your account.

You may not create multiple accounts for any purpose, including but not limited to manipulating rankings, circumventing bans, boosting, or win trading.

3. Acceptable Use

You agree not to:

  • Cheat: Use bots, scripts, macros, auto-clickers, browser extensions, or any software or hardware that provides an unfair advantage in games or rankings.
  • Exploit: Abuse bugs, glitches, or vulnerabilities. If you discover an exploit, report it to us at [email protected].
  • Manipulate Rankings: Engage in win trading, intentional losing, match fixing, ELO boosting, or any form of rating manipulation.
  • Harass: Engage in harassment, bullying, hate speech, threats, doxxing, or abusive behavior toward any user.
  • Impersonate: Pretend to be another user, staff member, or any other person or entity.
  • Spam or Advertise: Send unsolicited messages, advertise products or services, or flood any communication features.
  • Disrupt: Attempt to interfere with or disrupt the Platform's servers, networks, or services, including denial-of-service attacks.
  • Circumvent Security: Attempt to bypass, disable, or interfere with the Platform's anti-cheat, security, or moderation systems.
  • Scrape or Data Mine: Use automated tools to scrape, collect, or harvest data from the Platform without written permission.

4. Fair Play & Anti-Cheat

Competitive integrity is fundamental to Player Benchmark. We employ automated anti-cheat systems and manual moderation to ensure fair competition. We reserve the right to:

  • Monitor gameplay data, scores, and behavioral patterns for suspicious activity.
  • Flag, review, and invalidate scores or match results deemed illegitimate.
  • Temporarily suspend accounts pending investigation.
  • Permanently ban accounts confirmed to be cheating or violating these Terms.
  • Reset rankings, statistics, and achievements for accounts involved in manipulation.

Anti-cheat and moderation decisions are made at our sole discretion. If you believe a decision was made in error, you may appeal by contacting [email protected].

5. User Content & License

By using the Platform, you grant Player Benchmark a non-exclusive, worldwide, royalty-free license to display your username, scores, rankings, match data, and tournament results as part of the Platform's public features (leaderboards, profiles, tournament brackets, spectator mode, and replay system).

You retain ownership of your account. This license terminates when you delete your account, except for anonymized data that may be retained for leaderboard integrity as described in our Privacy Policy.

6. Tournaments

Tournaments on Player Benchmark are governed by additional rules specific to each event. By joining a tournament, you agree to:

  • Follow the specific format, rules, and settings of the tournament.
  • Be present and available for your scheduled matches during the tournament.
  • Accept the results as determined by the tournament system.
  • Not intentionally disrupt, stall, or sabotage tournament matches.

Failure to comply may result in disqualification and potential account sanctions.

7. Intellectual Property

All content on the Platform, including but not limited to the website design, game implementations, graphics, logos, and software, is the property of Player Benchmark and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.

8. Account Suspension & Termination

We may suspend or terminate your account at our discretion, with or without notice, if you violate these Terms or engage in conduct that we determine to be harmful to the Platform or its users.

You may delete your own account at any time through the Settings page. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

9. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that:

  • The Platform will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the Platform will be accurate or reliable.
  • Any defects will be corrected.

Your use of the Platform is at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Player Benchmark and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of rankings, loss of progress, or loss of access, arising from or related to your use of the Platform.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Player Benchmark, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Player Benchmark operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the applicable jurisdiction.

If you are a consumer in the European Union, you retain any mandatory consumer protection rights granted under the laws of your country of residence.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective date" at the top of this page and notify registered users where appropriate. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. If you do not agree with any changes, you should stop using the Platform and delete your account.
